A skeleton argument is a written summary of your case and your main arguments in your case.

It should outline the relevant background facts of the case and briefly refer to the law that will be relied on in your arguments.

You should also explain how you think the facts of your case relate to the law that you are referring to. Your skeleton argument should include a short timeline of relevant events to support your case.

It should also respond to the issues that have been raised by the other party.

  • When to prepare a skeleton argument?

    If the judge asks for skeleton arguments, your legal representative, or you if you do not have one, will need to prepare one. They are usually prepared for contested or final hearings and for appeal hearings.

  • Format, content and how to submit a skeleton argument

    There are strict guidelines on the structure and content of Skeleton arguments and how to submit them. They are outlined in a Skeleton Argument Practice Direction issued by the Northern Ireland Judiciary, in January 2021.

    You need to prepare the skeleton argument as set out in this Practice Direction.

  • Electronic submission

    Skeleton arguments should be submitted to the relevant court in electronic format by email either as a series of Word files or as an unlocked PDF file.

    Scanned documents should not be submitted.

    A read-receipt will be required as proof of lodgement.
